General Terms

 

It is understood that this contract is binding on both parties. It cannot be altered or changed unless agreed to in writing by the said parties, Contractor and Client.

 

I. THE PARTIES. This Contract ("Agreement") made on {{booked_date}} is by and between: Provider: AtomicDJ and Client: (Name included in Signature).

The Provider and the Client are each referred to herein as a "Party" and collectively as the "Parties."

 

II. EVENT INFORMATION. The Provider shall provide the Photo Booth for the following location: (Venue Address)

on the following date and time: (Event Date - Event Time)

 

III. PAYMENT 

A nonrefundable retainer fee of 25% is required to reserve the prospective date. AtomicDJ have the right to book another event if the retainer fee is not received by the due date with a signed contract. The Client agrees to pay a $40.00 service charged for all returned checks. THE ENTIRE BALANCE SHALL BE PAID 5 days before the event BY CASH, CHECK OR CREDIT CARD. Please make all payments out to: Atomic DJ

Client and Contractor may mutually agree to extend the Performance beyond the time specified above, at the listed rate per hour. Payment of over time is due at the beginning of each hour after time specified above. There will be a 10-minute grace period before overtime is incurred for any one-hour period. All provisions of this agreement shall continue to apply during any such extension of Performance.

 

IV. CANCELLATIONS AND POSTPONEMENTS 

Any event that is postponed or cancelled due to bad weather, serious injury, or death must be reported immediately. Contractor will still cater the new date of the postponed or cancelled event as long as the new date does not fall on a date reserved by another event. Any one event may be postponed twice; after the third postponement there will be $50.00 added onto the total cost of the contract for each postponement there after. The Client has 96 hours before the scheduled date of the event without prejudice. If an event is cancelled anytime less than 96 hours of the scheduled event any remaining balance of the contract that is left is due in full to Contractor. Contractor has the right to refuse any event within ten (10) business days of its commencement based solely on the death, injury requiring hospitalization or family crisis of the representative of the Contractor. The Contractor shall be responsible for finding a replacement for the Client, or the Client shall receive a full refund of monies spent for the down payment.

 

V. DAMAGES 

The Client will take reasonable steps to protect Contractor equipment, materials and personnel during Performance, setup and takedown. Any damages incurred due to lack of reasonable protection on Client 's part (except in the case of gross negligence or willful malfeasance by DJ) will be payable by Client to the extent of repair or replacement of damaged equipment, materials, and all costs of medical treatment.

 

IF SUIT BECOMES NECESSARY TO COLLECT MONIES OWED TO AtomicDJ, THE TOTAL COSTS OF COURT AND ATTORNEY FEES WILL BE ADDED TO THE TOTAL BALANCE OF THE CLIENT'S CONTRACTED SUM. PERSON (S) SIGNING BELOW SHALL SOLELY BE RESPONSIBLE FOR ALLPAYMENTS AND LIABILITIES UNDER THIS AGREEMENT

 

VI. GOVERNING LAW. This Agreement shall be construed and governed in accordance with the laws located in the State where the Event is taking place.

 

VII. ADDITIONAL TERMS & CONDITIONS. There will be a zero tolerance when it comes to harassment and unruly behavior towards our booth staff members. We have been hired to provide you with a positive and fun production, but will leave immediately if any of our team members feel unsafe. It's in our best interest to keep the party going, so we will contact the client of any attendees being belligerent. Payment will not be refunded if this type of incident occurs.

 

VIII. ENTIRE AGREEMENT. This Agreement constitutes the entire agreement between the Parties. No modification or amendment of this Agreement shall be effective unless in writing and signed by both Parties.

 

IX. EXECUTION. The Provider and the Client each represent and warrant to the other that each person executing this Agreement on behalf of each party is duly authorized to execute and deliver this Agreement on behalf of that party.
